Useful information regarding access to justice


1. Timeliness

Because time is precious and we are tired of the length of litigation, it is important to know that:

  • Recently, there have been several amendments to laws related to litigation procedures that contribute to reducing their duration
  • The notification procedures for judicial papers have been amended
  • Penalties will been imposed on the one who procrastinates and abuses his rights during the proceedings


2. Justice Sector Services

Technology is also important in justice sector services, therefore it is important to know:

  • Electronic services have been offered, including for obtaining a certificate of non-criminal record
  • Work hours have been extended
  • There are licensed notaries of law outside the courts
  • Inquiries about cases, applications, and notary transactions are available through the Ministry's website
  • One is able to register cases and pay fees electronically without the need for court review


3. Cost of Litigation

Poverty and material weakness should not be reasons to lose our rights, therefore it is important to know:

  • It is possible to apply to delay court fees
  • You can request a reservation before the Court of Appeal without a deposit in urgent cases


4. Legal Aid

There are those that help and provide expert legal services, so it is important to know:

  • The law required the presence of a lawyer in many civil and criminal cases
  • There are various agencies that offer free legal assistance, including the Ministry of Justice, the Bar Association, and some local and international organizations


5. Rule of Law and Combatting Wasta

Because wasta is an injustice of society, and because wasta is not a right, it is a crime against your rights and the rights of others, therefore it is important to know:

  • Wasta is a crime punishable by law
  • The judiciary is the correct way to obtain your rights


6. Friendly Environment for Refugees

Refugees have rights protected by the law, therefore it is important to know:

  • Refugees have the right to access legal aid
  • All are equal in the face of the law in regards to rights and responsibilities, regardless of nationality


7. Friendly Environment for People with Disabilities

Disabilities are not a reason to lose one's rights, therefore it is important to know:

  • The law requires institutions to enable people with disabilities to access their services


8. Protection and Rehabilitation of Juveniles

Rehabilitation of juveniles is more important than incarceration, and all of us have an important role in changing the stereotype of sentenced youth, therefore it is important to know:

  • The minimum age of criminal responsibility was raised from 7 to 12 in accordance with international standards
  • Amendments to the Juvenile Justice Law introduce alternatives to detention, focusing more on rehabilitation
  • The Juvenile law offers protection and childcare


9. Empowering environment to support access to justice for women

Because women’s access to justice is the foundation for gender equality, and because achieving political, economic, and social justice for women is essential, it is important to know about a number of recent legal amendments that include:

  • Increase in the number of elected women in the parliament
  • Cancelation of Code 308 that exempt rapists from punishment
  • Increase in the number of women judges on the courts
  • An alimony fund has been started
  • Paid maternal leave is covered by social security
  • A more flexible work system has been enacted that allows women to work from home
  • Verbal harassment has been criminalized under recent penal code amendments
  • Several agencies that offer social, health, educational, and other services are legally liable for reporting, and required to report, cases of domestic violence
